Terms of Use

1. Overview

These Terms of Use ("Terms") govern your purchase and use of the Get Skills MD agent ("the Product"), operated by AI Creative Solutions ("we," "us," "our"). By purchasing the Product, you agree to these Terms in full.

2. Product Description

The Product is a digital AI agent hosted on the MindStudio platform (mindstudio.ai). Upon purchase, you receive a link to copy ("Remix") the agent into your own MindStudio workspace. The agent generates SKILL.md files — structured markdown files used to extend AI agent capabilities across multiple platforms.

3. Purchase and Delivery

3.1 Payment

Payment is processed through Gumroad. By completing a purchase, you also agree to Gumroad's Terms of Service.

3.2 Delivery

After payment, you will receive a link to the agent on MindStudio. Clicking "Remix" copies the agent into your own MindStudio workspace. Delivery is considered complete once you receive the remix link, regardless of whether you have activated it.

3.3 No Refunds

All sales are final. No refunds will be issued under any circumstances. Because the Product is a digital agent delivered instantly via a copy link, refunds are not possible once the link has been provided.

4. Ownership and Usage Rights

4.1 Your Copy

Once copied to your MindStudio workspace, the agent is yours. You may modify, extend, rebrand, and use it for any lawful purpose without restriction.

4.2 Skills You Create

Any SKILL.md files or other outputs generated by the agent are entirely yours. You may use, distribute, and sell them freely. We claim no ownership, royalties, or rights of any kind over your outputs.

4.3 No Ongoing Obligation

There are no recurring fees, royalties, or revenue-sharing obligations to us. Your purchase is a one-time transaction.

4.4 Redistribution of the Agent

You may not redistribute, resell, or share the agent itself (the MindStudio agent configuration and its knowledge base). You may freely redistribute any skills or outputs the agent produces.

5. MindStudio Platform

5.1 Account Required

A MindStudio account is required to use the Product. MindStudio is a third-party platform operated by YouAi Inc. We are not responsible for MindStudio's availability, pricing, features, terms, or any changes to their service.

5.2 Usage Costs

Running the agent in your MindStudio workspace incurs inference costs charged by MindStudio, not by us. You are solely responsible for all MindStudio usage fees.

6. AI Disclaimer and Limitation of Liability

6.1 AI Can Make Mistakes

The Product uses artificial intelligence to generate SKILL.md files. AI-generated output can contain errors, inaccuracies, omissions, or other flaws. You are solely responsible for reviewing, testing, and validating all output before deploying or distributing any skill.

6.2 No Warranty

The Product is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, whether express, implied, or statutory. We make no warranties regarding the accuracy, reliability, completeness, suitability, or fitness for any particular purpose of the Product or its outputs.

6.3 Zero Liability

To the maximum extent permitted by applicable law, AI Creative Solutions shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:

• Your use of or inability to use the Product
• Any errors, inaccuracies, or deficiencies in skills generated by the agent
• Any decisions made or actions taken based on the Product's output
• Any loss of data, revenue, profits, or business opportunities
• Any third-party claims arising from skills you create, distribute, or sell
• Any issues with the MindStudio platform, including downtime, data loss, or pricing changes
• Any security vulnerabilities in generated skills

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

6.4 Your Responsibility

You accept the Product with full understanding that:

• AI-generated content requires human review before use
• You must vet all skills for correctness, security, and fitness for purpose
• You assume all risk associated with using, deploying, or distributing generated skills
• Third-party skills may contain security vulnerabilities — you are responsible for security review

7. Indemnification

You agree to indemnify, defend, and hold harmless AI Creative Solutions and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Product, any skills you create or distribute, or your violation of these Terms.

8. General Provisions

8.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Creative Solutions regarding the Product.

8.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

8.3 Modifications

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Product after changes constitutes acceptance of the revised Terms.

8.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law principles.
